Pluralismo jurídico y jurisdicción comunal en la jurisprudencia del tribunal constitucional peruano, 2023
Abstract
Desde hace mucho tiempo se habla del pluralismo jurídico. De manera concreta, el siglo XVII es el siglo en el que se habla de pluralismo. Tiene como base el principio de la igual dignidad de pueblos y culturas. Es decir, que no hay pueblos o culturas superiores ni inferiores, ni sometidas a una relación de subordinación o dominación, como acontecía en era colonial. Por ello, se planteó como objetivo general: Determinar qué relación existe entre el pluralismo jurídico y el tratamiento de la Jurisdicción Comunal en la Jurisprudencia del Tribunal Constitucional Peruano. Tipo y nivel de estudio fue: cuantitativo, básica y correlacional. En una muestra probabilística de 80 cuyos Resultados: Se observa que el 81.2% (65) de los participantes piensan que es medio el Pluralismo Jurídico, alto en un 13.8% (11) y bajo en un 5.0% (4). Se observa que el 76.2% (61) de los participantes piensan que es medio la Jurisdicción Comunal, alto en un 15.0% (12) y bajo en un 8.8% (7). Concluyendo: Que existe relación directa entre el pluralismo jurídico con el tratamiento de la Jurisdicción Comunal en la Jurisprudencia del Tribunal Constitucional Peruano.
